Vallauris: court upholds judicial review of motorcyclist involved in accident with girl who lost her life

Judicial supervision of motorcyclist involved in fatal accident in Vallauris confirmed

The investigating chamber of the Aix-en-Provence Court of Appeal has ruled that the young motorcyclist accused of fatally colliding with a little girl in Vallauris will not be remanded in custody.

A decision expected after the public prosecutor’s appeal

Following an appeal by the Grasse public prosecutor’s office, the investigating chamber of the Aix-en-Provence court of appeal handed down its verdict on Wednesday September 10. The judicial supervision of the main suspect, a young man involved in the accident that claimed the life of a 7-year-old girl in Vallauris, was maintained. Despite requests from the public prosecutor’s office for him to be remanded in custody, the court ruled that there was insufficient reason to incarcerate him.

The young man remains subject to the obligations of his judicial supervision, notably the suspension of his driving license, the obligation to report every two weeks to the Antibes police station, and the ban on contacting the victim’s family or leaving the Alpes-Maritimes département.

“No risk of pressure or repetition of the acts”.

Indicted on September 7 for “unintentional injury resulting in total work incapacity of more than three months through deliberate breach of a duty of care”, the young motorcyclist was present at the hearing, accompanied by his lawyer. The president of the court explained that the remand in custody could not be justified by the emotion, however strong, aroused by this case. He also stressed the absence of any risk of pressure on witnesses or of recidivism, which motivated his decision to maintain the case under judicial supervision.

The family’s dismay

The Court of Appeal’s decision came as a deep disappointment to little Kamilya’s family, who had hoped that the motorcyclist would be remanded in custody. Their lawyer expressed the parents’ “strong sense of injustice”. In a message posted on social network X, he said that the family was now waiting for the investigation to shed full light on the tragedy.

A stern warning

Despite the decision not to place him in custody, the president of the investigating chamber warned the young man that any breach of his judicial supervision obligations would result in immediate incarceration. This warning underlines the seriousness of the situation in which he finds himself, and the importance of strict compliance with the conditions imposed on him.
